MATERNITY GOWN RENTAL AGREEMENT

CAREFULLY READ THE TERMS AND CONDITIONS OF THIS AGREEMENT. BY ORDERING PRODUCTS OFFERED ON OUR SITE AND MAKING PAYMENT, YOU ARE AGREEING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT. 

WE RESERVE THE RIGHT TO CHANGE THE TERMS OF THIS AGREEMENT ANYTIME IN THE FUTURE AND ANY CHANGES WILL APPLY TO THE RENTAL OF ANY PRODUCTS AFTER THE DATE OF SUCH CHANGE.

 

ARTICLE 1

Rental Agreement:

 

Blanc Studio One Rentals (also known as B+B) hereby leases for a specified period to the below named person (from herein known as Renter), and Renter hereby rents from Blanc Studio One Rentals, the gown(es) described on the Rental Reservation Form on the terms and conditions set forth herein for the time period indicated (Start Date/End Date). All gowns shall remain the property of Blanc Studio One Rentals and must be returned upon demand.

 

Blanc Studio One Rentals liability under this Rental Agreement shall in all cases, including without limitation, failure of delivery of the gown(es), be limited to the return of all sums paid by Renter to Blanc Studio One Rentals on account of the rental provided herein.

 

ARTICLE 2

Rental Basics:

 

-All gown rentals and jewelry rentals will be up to 5 days in length, beginning on the day that the gown is received by the Renter, including Saturday and Sunday. Refunds are not given for gowns returned early. Additional rental days are available upon request for an additional fee. Reservations may not end on a Sunday.

 

-Return date will be specified on rental instructions included with gown pick-up. Reservations cannot end on a Sunday.

 

-If a shipment to a Renter is delayed, B+B will work alongside the Renter to reasonably compensate for any missed time. Please contact B+B for approval to keep a gown for longer than the reserved period.

 

ARTICLE 3

Rental Essentials:

 

-All renters must be at least 18 years of age. Parents may rent for children.

 

-For hygienic reasons, please wear underwear while wearing all gowns.

 

- Damages to the gown will result in additional fees or the cost of replacement of the gown. RUB ON TANNING PRODUCTS ARE FORBIDDEN.

 

-Gowns and jewelry will not be altered by the Renter, and gowns must not be damaged upon return. Damage fees will be assessed for alterations and will be withheld from any deposit, and if the gown is permanently altered, Renter will be charged the full price of the gown.

 

-No additional cleaning charge will be assessed unless the gown is returned damaged or dirty. Dry clean the gown is FORBIDDEN.

 

-Gowns may 'bleed', transfer, or rub color onto your skin and/or clothing/underwear/tights when worn and B+B cannot be held responsible for such damages and is not permitted to compensate Renter for or replace such garments. Using the gown is at the risk of the Renter and may include damage to under garments.

 

ARTICLE 4

Payment:

 

-All rental cost due from the Renter must be PAID IN FULL AT TIME OF RESERVATION to hold the gown for Renter's event dates. The gowns are not considered reserved until full payment is completed and if payment is not received in 24 hours of invoicing, the reservation will be automatically cancelled and the gowns may become unavailable or rented to the next buyer.

 

-All gown and jewelry rentals must be paid for prior to use. Any gowns used without payment will result in forfeiture of deposit on top of full rental fee charge.

 

-Security deposits are at the discretion of B+B and will be collected prior to pickup of any gowns.

 

-Collections: If Renter does not pay the fees to B+B when they are due, then we may institute collection procedures. Renter agrees to pay our costs of collection, including without limitation, reasonable attorneys’ fees and may be enforced in the state of Texas. Renter will also be prohibited from renting gowns from B+B in the future.

 

ARTICLE 5

Sharing Information

 

-B+B will not distribute any credit card information obtained from the Renter. B+B will attempt to collect all payments via secure electronic capture to prevent fraudulent transactions.

 

-B+B will not sell or attempt to sell any information collected from the Renter and will keep all account and reservation information private. We will provide individually identifiable information about our consumers to third parties only if we are compelled to do so by order of a duly-empowered governmental authority, we have the express permission of the consumer, or it is necessary to process transactions and provide our services.

 

ARTICLE 6

Cancellation:

 

-Any cancellation of a gown rental or jewelry reservation greater than 7 days before the start date will incur a forfeiture fee of 25% of the rental fee per gown for event rentals with 75% refunded to Renter.

 

-Cancellation within 7 days of the start date will incur the full rental fee per gown or per jewelry set. 

 

-There are no refunds or pro-rated refunds or credits of any type offered due to Renter not using or wearing a reserved gown that has been shipped to them. 

 

-Switching from a previously reserved gown to another available gown may result in a 25% charge plus the full price of the new gown.

 

ARTICLE 7

Late Fees:

Late fees are strictly enforced

 

-gowns not returned within 2 Day rental period on or before the specified date will be charged $50 per day, for each gown sent late, until the gown is received, which will be due immediately charged to the Renter’s credit card.

 

-Jewelry rental late returns are $10/day. The same return agreement applies to jewelry rental as gown rental.

 

ARTICLE 8

Loss/Theft:

 

-gowns and jewelry not returned after 10 days will be charged the full purchase price of the rental gown, which will be determined as the price of the rental multiplied by 15, or the posted purchase price of the gown. Renter is responsible for the safety of the gowns/jewelry while in their possession and agrees to pay for the loss of any gown/jewelry.

 

RENTER ACKNOWLEDGES THAT Blanc Studio One Rentals HAS NOT AND DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, DIRECTLY OR INDIRECTLY, EXPRESS OR IMPLIED, INCLUDING THE SUITABILITY OF THE GOWN(S), ITS FITNESS FOR ANY PARTICULAR PURPOSE, ITS CONDITION AND/OR ITS QUALITY AND RENTER ACCEPTS ALL GOWNS IN “AS IS” CONDITION. This applies to sales of gowns as well.

 

RENTER IS SOLELY RESPONSIBLE FOR THE SAFE CARE AND TIMELY RETURN OF THE GOWN(S) AND ANY ACCESSORIES IN GOOD CONDITION, AND RENTER SHALL BEAR THE ENTIRE RISK OF LOSS OR DAMAGE TO THE GOWN(S).

 

I agree to all terms set forth and that Blanc Studio One Rentals and agree to cover the cost of the gown rental(s), and any damages/loss/theft and/or late charges. 

 

I agree to allow B+B to charge my credit card to cover these costs and any additional fees owed to B+B.

By creating an account or paying for a reservation on a gown, Renter affirms agreement to all terms herein stated.

Governed by the laws of the State of Texas and Wichita Falls, Texas.

 

IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, PLEASE DO NOT PLACE AN ORDER.
